JSR 294 Observer license

The notice below was sent on 4/27/2009. Before 4/27/09, there were 22 mails on the observer list from seven individuals who are not JCP members or affiliated with/employed by JCP members.

The purpose of this observer list is to allow anyone to observe the traffic on the JSR 294 Expert Group mailing list. Posting to the observer list is enabled so that observers may participate in wider commentary on EG discussions.

In the course of such participation, an observer may make contributions which the JSR's spec lead (Sun) considers would inform and improve the JSR. If the spec lead is to accept such contributions, a legal agreement needs to be in place between the spec lead and the observer.

This principle is no different than other standards development organizations and open source projects. Without a real grant from contributors, the editor/assembler of a technology and the downstream users cannot have sufficient confidence to invest in building products based on the technology.

There are two kinds of observers on this list: those who are JCP members and those who are not. Observers who are JCP members have already granted the spec lead a license to their contributions by signing the JSPA.

Observers who are not JCP members have not granted the spec lead any such license. In order to be able to accept future contributions from observers who are not JCP members, Sun publishes the notice below.

Notice to Participants in Public Alias for JSR 294 Expert Group: Improved Modularity Support in the Java(TM) Programming Language

1. No Expectation of Confidentiality.

By choosing to participate in this Public Alias for JSR 294, you acknowledge and agree that any information you disclose to any other participant related to the work of the Expert Group for JSR 294, including but not limited to any "Contributions" as that term is used in the JSPA, shall be be considered non-confidential and non-proprietary information, regardless of any markings to the contrary included thereon. The JSPA defines Contributions as "any comments, specifications, code or other materials, or ideas made or disclosed to an Expert Group concerning the subject matter of the JSR for which that Expert Group is formed."

2. License Grant from Non-JCP Members.

If you are not a signatory to a current Java Specification Participation Agreement with Sun Microsystems, Inc. ("Sun"), whether as an individual or through your employer, then by your submission of any Contributions (as defined above) to this Public Alias for JSR 294 you hereby grant to Sun a worldwide, unrestricted, royalty-free, fully paid-up, irrevocable, perpetual, non-exclusive license to use, make, have made, sell, offer to sell, import, reproduce, prepare derivative works of, publicly display, publicly perform, transmit, distribute, sublicense or otherwise transfer such Contributions, and/or derivative
works thereof, in whole or in part, alone or in combination with or included in any product, work or materials arising out of the work of the Expert Group, and authorize third parties to do any, some or all of the foregoing including, but not limited to, sublicensing others to do any some or all of the foregoing indefinitely. You represent and warrant that, to the best of your personal knowledge, you are legally entitled to grant this license and that your Contribution does not violate any other party's copyrights, trademarks, patents or other intellectual property rights.
