The Apache Software Foundation (ASF) finds the vague nature of the business terms for JSR 88 disturbing. We believe that no clear path to open source independent implementations of J2EE 1.4 components is shown by the statement of business terms, since they appear to be essentially unaltered from those of J2EE 1.3. Further, we believe that no clear path to J2EE compliance for such independent implementations is clear from the TCK licensing and terms of use.

Specifically, ASF would like Sun and the JSR 88 expert group to explain in detail how the proposed business terms for JSR 88 would allow solutions in the following examples:

1) the continuing lack of availability of a current and independent open source binary version of the JDK on FreeBSD, OpenBSD, and NetBSD
2) the licensing issues between Sun and Lutris concerning Lutris'  proposed open source licensing of their Enhydra project.

Unfortunately, without a far better understanding of the specific business terms which allow such solutions, ASF finds itself obligated to vote No on JSR 88. We cannot in good faith to our constituency, the open source community, approve carte blanche for the expert group with respect to these terms as stated.
