Oracle is voting in favor of this long awaited JSR in the interest of finally progressing it toward final approval.  However, we share in principle BEA's concern about some aspects of the proposed TCK license and look forward to working with Sun, BEA and others to address these issues.

While significant progress has been made, SAP believes that the language in the proposed TCK license is still very ambiguous in various key areas, as noted also by other EC members. We have shared our concerns with Sun and were assured that the proposed TCK license has not been finalized and continuous improvements will be made until Final Release. Should the TCK license remain unchanged, SAP would not be able to vote favorably for this JSR in the next Ballot. Nevertheless, we believe that it is in the best interest of the Java community to allow this JSR to advance to the Public Review stage and while we went on record with our concerns about the TCK license, SAP believes that at this point the priority is to make further technical progress by incorporating the feedback of the entire Java community.

We are aware that several members of the EG have issues with this JSR moving forward. IBM supports these members' concerns and will work with Sun to resolve them prior to the next ballot. IBM's vote is based on the technical merits of this JSR and is not a vote on the licensing terms.  IBM supports licensing models that create an open and level playing field by allowing third parties to create independent implementations of Java Specifications and that do not allow individuals or companies to exercise unnecessary control for proprietary advantage.  We support open source as a licensing model for contributions in the JCP, and would hope others will support this direction. This comment is not necessarily directed at the current business or license terms for this JSR, however, it is a statement of IBM's preferred licensing model.

After careful review of the proposed TCK license, we believe that Sun may intend to reserve the right to block or time shipment of products tested with the TCK, even if that product ultimately is not offered as a Java compatible Product. These and other issues among the Expert Group must be addressed by the next Ballot, or we will be unable to vote for passage at that time.
