The Spec Lead has confirmed that the JSR 314 TCK License will not contain field of use restrictions that limit use of Independent Implementations.

The rest of this is a comment we make in each ballot.  The JCP TCK requirement for gaining access to pooled intellectual property is intended to ensure compatability, not to restrict or limit competing implementations.  We are concerned about Apache's inability to get a TCK License for Java SE 5 that does not restrict how they can use their own implementation (as described in their open letter and FAQ).  When the public can not view the TCK License, we ask the Spec Lead to confirm that there are no field of use restrictions in the TCK License (e.g. does not prevent use of the  implementation on particular devices or operating systems as a condition of using the TCK to test).

IBM's vote is based on the technical merits of this JSR and is not a vote on the licensing terms.  IBM supports licensing models that create an open and level playing field by allowing third parties to create independent implementations of Java Specifications and that do not allow individuals or companies to exercise unnecessary control for proprietary advantage.  We support open source as a licensing model for contributions in the JCP, and would hope others will support this direction. This comment is not necessarily directed at the current business or license terms for this JSR, however, it is a statement of IBM's preferred licensing model.
