Apple is happy with the progress made with the new JSPA, so we're voting yes because of that..  At the same time, we have one major concern that we hope is addressed before the next step in the process.

Apple's main concern with the JSPA Agreement is that the license granted by
contributors in sections 4 and 5 is too broad.  It goes beyond patent claims
required to implement the Spec. and could be interpreted to cover ANY
patents the independent implementation might infringe, including patents
covering aspects of the implementation that are unrelated to the
functionality required by the Spec., i.e, other product features, other
technologies that are included in the same product. In section 4, it states
we have to license all patents that cover any technically feasible
implementations. This language seems inconsistent with the language in
Section 6 which creates exceptions to the patents that are licensed.
Perhaps you mean for those exceptions to apply, but this needs to be
clarified.
